Regulations

The legal framework governing extended producer responsibility, and the conditions under which we operate.

What the law requires

The key legal obligations of extended producer responsibility, organised and explained article by article.

The obligation applies to everyone who produces or imports motor oils

Anyone who produces or imports motor or industrial oils has a legal obligation to provide a system for collecting the waste oils that arise from them. The law sets the costs of meeting that obligation, along with the consequences and the costs of failing to.

Obligation

The obligation is mandatory for every producer

Under the law, since 31 December 2023 producers must either organise through a licensed collective scheme operator or obtain a permit to handle the obligation independently.

ЗУДТО чл. 72(4)–(5)

Fee

45 denars instead of 150 denars

Producers pay a fee of 150 denars for managing waste oils, while those meeting the obligation through a licensed collective scheme operator pay 45 denars.

ЗУДТО чл. 23(2)(1) · чл. 25

Scope

Five categories, fifteen tariff codes

Motor oils, gear oils, brake fluids, hydraulic oils and greases — all measured in kilograms. Exactly what falls in scope is defined by fifteen customs tariff codes, published on the Services and law page.

ЗУДТО чл. 2

Supervision and public transparency

A licensed collective scheme operator has clearly defined legal obligations: meeting the national targets, reporting regularly, and publishing part of the data about its operations.

National targets

From 15% in 2025 to 45% in 2031

Collection targets for waste oils are set as a share of the quantity placed on the market the previous year: 15% for 2025, 20% for 2026, 25% for 2027, 30% for 2028, 35% for 2029, 40% for 2030 and 45% for 2031.

ЗУДТО чл. 17(1)

Reporting

Monthly declarations, quarterly filing

Members file monthly or quarterly declarations through the portal. Eko Fluid then reports quarterly to the competent authority, based on the monthly reports from contracted producers. Responsibility for the accuracy of the data stays with the member.

ЗПО чл. 31(3)

Publicity

The fee is published because the law says so

The fee must appear prominently on this site. Next year's fee is published by 15 November at the latest, and any change within 10 days of it taking effect.
